Filing of the trademark application

Examination

After the Intellectual Property Office of Australia receives the application, it will review the file and determine if the application have met the minimum filing requirements.

Publication

If the trademark is accepted to registration, it will be published in the Official Journal of Trade Marks. From the publication date, third parties have a three month term in order to file oppositions based on the belief that the published application might be detrimental to their rights, and/or if in their opinion, the mark that has been requested, must not be registered.

Acceptance

If no opposition is filed, or filed oppositions are unsuccessful, trademark will get registration, as soon as registration fee is paid, which must be done no later than 6 months from the date in which the acceptance was published.

Registration Certificate

Once the trademark has been registered, the Intellectual Property Office of Australia will send a Certificate of Registration to the applicant, and will record the trademark details at the Register of Trademarks.

Duration of the registration

The protection of a registered trademark will last for ten years, and will be calculated from the date in which the trademark application was filed.

Proof of use

Please note that according to Australia’s law, if the trade mark has not been used by its owner or in his/her behalf, for a period of 3 years, an application for removal from the Trade Marks Register can be made.
